Estate Planning, Trust Administration & Probate in Riverside County
Estate planning and estate administration depend on the documents, ownership, and circumstances involved—not simply a mailing address. Codi M. Dada Law Office P.C. offers virtual services across California from its Novato office.
Plan for incapacity and the transfer of assets
Planning while you are alive can help clarify who may act for you and how your property should be managed or transferred. Depending on your circumstances, an estate plan may include a will, living trust, financial power of attorney, and advance health care directive. A financial power of attorney and a health-care directive serve different roles.
A trust plan should be coordinated with the ownership of your assets. Creating a trust document alone does not establish how every asset will transfer. Review deeds, account ownership, beneficiary designations, and existing planning documents together, and choose an appropriate person who knows where important documents are kept.
- Gather existing wills, trust documents, powers of attorney, and health-care directives.
- Make a list of real estate, financial accounts, and other significant property, noting how each is owned and any beneficiary designation.
- Consider who you would want to handle financial and health-care matters if you could not act for yourself.
Trust administration after a death
After a death, trust administration involves reviewing the trust and related records, identifying assets held in the trust, and determining what steps are required to carry out its terms. The right transfer procedure can depend on how property is titled and whether beneficiary designations apply. Property connected to a trust does not by itself establish that no other proceeding will be needed.
Organizing a clear asset inventory is a practical starting point. Record each asset’s type, ownership, and estimated value as of the date of death. For real property, the county recorder where that property is located holds the property records. Trust administration is distinct from planning during life and from a court-supervised probate case.
- Locate the trust and any amendments, deeds, account statements, and beneficiary records.
- List assets and note whether each appears to be held individually, in trust, or with a named beneficiary.
- Keep records of the decedent’s residence and the locations of any California real property.
Riverside County probate: residence, property, and filing resources
Whether a formal probate case is appropriate depends on the estate’s circumstances and how its assets are owned. A mailing label or the place where a relative lives does not, by itself, determine where a case belongs. For a person who lived in California, probate is usually filed in the county where the decedent lived. If the decedent lived outside California but owned property here, a filing may be required where that California property is located.
Formal probate includes opening a case, administering the estate, and closing it. The court appoints a personal representative, who inventories assets, addresses debts, and reports before final distribution. A will may nominate an executor, but nomination is distinct from appointment by the court.
The Riverside County Superior Court Probate Division provides separate resources for filing location, probate notes, case access, and remote appearances. It lists Riverside, Palm Springs, and Southwest Justice Center locations. Confirm the actual case assignment rather than selecting a courthouse based only on a city name. The court’s resources can help with local case logistics; they do not determine how documents signed during life should be prepared.
Preparing to discuss your situation
Before a consultation, gather the documents and basic facts that help distinguish planning needs from administration or probate questions. A concise, organized record can make it easier to identify what is known and what needs follow-up.
- For planning: bring current estate documents and a list of people you may want to name for financial or health-care roles.
- For trust administration or probate: bring the trust or will, if available, and a preliminary asset list showing ownership and estimated date-of-death values.
- For a Riverside County matter: note where the decedent lived and where any real property is located, and retain relevant deeds or recorder information.

Common questions
Does living in Riverside County mean a probate case must be filed there?
Not automatically. Filing depends on the decedent’s residence, property location, and the circumstances of the estate. California probate is usually filed in the county where the decedent lived; an out-of-state decedent’s California property can require filing where that property is located. Confirm the appropriate venue and case assignment for the specific matter.
Can I handle everything remotely?
Consultations may be available virtually, including for clients outside Novato. A remote consultation does not automatically authorize remote document signing or remote court appearances. Court appearance options and case logistics should be checked for the particular proceeding.
