Plan for incapacity while you are alive

Estate planning can prepare for both financial and health-care decisions if you cannot make them yourself. A financial power of attorney and an advance health care directive serve different roles, so consider what decisions each document should address and who you want to name. A will can state your wishes for property distribution and nominate an executor, but that nomination is not the same as appointment by a court.

A living trust can be part of a plan for managing property during life and directing its later transfer. The plan needs to coordinate with asset ownership: a document alone does not change how an asset is titled. Beneficiary designations and the way property is held can also affect how it transfers. Keep a clear record of important documents and make sure an appropriate person knows where to find them.

  • Gather a current list of real estate, financial accounts and other significant property.
  • Record how each asset is owned, including any trust title or beneficiary designation.
  • Consider who should make financial and health-care decisions if you cannot act.

After a death: trust administration and court probate

Trust administration and probate are different processes. When a person dies with a trust, the person responsible for administering it may need to identify trust assets, review the trust terms and address administration before distribution. Whether an asset is trust property depends in part on its title; a trust plan does not automatically resolve every asset or eliminate every possible court proceeding.

Court probate is a formal process that includes opening a case, administering the estate and closing it. If probate is needed, a court appoints a personal representative. That representative inventories assets, addresses debts and reports to the court before final distribution. A will may nominate an executor, but the court appointment is a separate step. Not every estate requires probate; the available transfer procedure depends on the assets and how they were owned.

  • Collect the will, trust and related amendments, if available.
  • List assets, how each was owned, and its estimated value at the date of death.
  • Note beneficiary designations and identify property that may be held in trust.

Palm Desert property and Riverside County filing considerations

Palm Desert is in Riverside County, but a city name or mailing address alone does not determine where a probate case belongs. Probate is usually filed in the county where the decedent lived. If the person lived outside California but owned property in the state, a filing may be required where that California property is located. Residence and property ownership therefore matter more than the label on an address.

For real estate, records are held by the recorder in the county where the property is located. If a matter involves a court case, Riverside County Superior Court’s Probate Division provides separate information about where to file, probate notes, case access and remote appearances. It lists Riverside, Palm Springs and Southwest Justice Center locations; verify the actual case assignment rather than selecting a courthouse based on the city name. Remote consultations do not automatically authorize remote document signing or court appearances.

Preparing for a virtual consultation

Codi M. Dada Law Office P.C. has one office at 802 Grant Ave, Novato, CA 94945, and offers virtual services statewide. Before a consultation, organize the documents and information relevant to your question: existing estate-planning documents, a property and account list, ownership details, beneficiary designations, and—if a death has occurred—basic information about the decedent’s residence and any California property. This helps clarify whether the issue concerns planning during life, administration of a trust or possible court probate.

Common questions

Does every Palm Desert resident have to file probate in Riverside County?

No. A person’s city of residence does not by itself determine whether probate is needed or where a case belongs. The decedent’s residence and the location of California property can matter; confirm the appropriate filing location for the specific case.

Does a virtual consultation mean I can sign documents or appear in court remotely?

No. A remote consultation does not automatically authorize remote signing or a remote court appearance. The requirements depend on the documents and the court matter.
