Before acting as an executor nominee

Being named as executor in a will is a nomination; it does not, by itself, make you the court-appointed personal representative. If formal probate is needed, the court appoints a personal representative to administer the estate. Before taking steps on behalf of an estate, clarify whether a court appointment or another transfer process applies.

Start by locating the will, any trust documents, financial power of attorney and advance health care directive. These documents serve different purposes: a financial power of attorney concerns financial matters during life, while an advance health care directive addresses health-care decisions. Ask the person who created the documents where originals and related records are kept.

  • Make a preliminary list of assets and debts, noting the type of property and how each asset is owned.
  • Record whether property appears to be held in a trust or has a beneficiary designation.
  • For real estate, note the property’s location and gather available ownership records.

Planning while you are alive

Estate planning is done during life to set out how decisions and property should be handled. A plan may include a will, living trust, financial power of attorney and advance health care directive. Which documents are useful depends on your circumstances and goals.

A trust plan needs to coordinate with asset ownership. Creating a trust does not, on its own, establish that every asset is titled in the trust or that no court proceeding will be needed. Review how property is owned, along with beneficiary designations, as part of planning. Virtual consultations are available statewide, but a remote meeting does not automatically authorize remote signing; signing requirements depend on the documents and applicable rules.

Trust administration and probate are different processes

Trust administration concerns carrying out a trust’s terms after a death or another event specified by the trust. The trustee should review the trust, identify assets held in its name, and understand which property may pass by a different route. Not every asset associated with a person is necessarily a trust asset.

Formal probate is a court process that can involve opening a case, administering the estate and closing it. When appointed, a personal representative inventories assets, addresses debts and reports to the court before final distribution. A will can nominate an executor, but it does not itself confer court appointment or necessarily eliminate the need for probate.

Why the decedent’s residence and property location matter

For a California resident, probate is usually filed in the county where the decedent lived. If the decedent lived outside California but owned property here, a filing may be required in the county where that California property is located. The relevant facts are the decedent’s residence and asset locations—not simply the mailing label on a document or the city where a family member lives.

To assess the next step, organize the decedent’s residence history, will and trust documents, asset list, ownership information, beneficiary designations and known debts. Real-property records are held by the recorder in the county where the property is located. Solano County’s Probate Department handles decedent estates and trusts; its court information identifies the Hall of Justice in Fairfield. Whether a particular estate belongs in Solano County depends on the circumstances.

Common questions

Does a Dixon address mean probate must be filed in Solano County?

Not by itself. The decedent’s residence generally guides the county for a California resident’s probate; California property owned by someone who lived out of state can point to the county where that property is located. A mailing address alone does not settle the question.

Can I handle estate planning or probate entirely by video?

Consultations can be conducted virtually, including for clients outside the Novato area. That does not automatically mean documents can be signed remotely or court appearances can be made remotely. Those questions depend on the document and applicable court requirements.
