Executor and Trustee Guidance in Felton, Santa Cruz County
A will may name an executor, and a trust may name a successor trustee, but those roles do not share the same source of authority. Before relying on a document or beneficiary arrangement, clarify what it says, who owns each asset, and whether a court appointment is involved. Codi M. Dada Law Office P.C. has one physical office in Novato and provides virtual services throughout California, including for people in Felton.
A will nomination is not a court appointment
A will may nominate someone to serve as executor. The nomination alone, however, does not appoint that person as the estate’s personal representative; the probate court makes the appointment. If you are named in a will, distinguish the document’s nomination from any court appointment before treating yourself as authorized to act for the estate.
Keep the will and any court papers together, and make a note of what the papers say about your role. If no appointment has been made, or you are unsure what an appointment covers, ask counsel to clarify your status before taking steps on behalf of the estate.
A successor trustee should check both the trust and asset ownership
A successor trustee’s role depends on the trust’s terms and on which assets are owned by the trust. A name in the document does not, by itself, answer whether a particular account or property is part of the trust. Compare the trust language with available ownership records before assuming the trust governs an asset.
Trust administration is not necessarily free of court involvement. A dispute or a question about interpreting the trust may require court involvement. If family members disagree about a provision, or the records do not make ownership clear, identify that issue for legal advice rather than treating the trustee designation as the whole answer.
Compare the documents with beneficiary and ownership records
A will, a trust, and an asset’s ownership or beneficiary records may relate to different parts of a family’s arrangements. Before relying on one document to answer questions about every asset, gather the records that show how each item is titled and who is listed as beneficiary, where that information is available. Trust administration depends in part on ownership, so a document’s general instructions may not settle how a particular asset is handled.
For a focused review, sort records by asset and note the owner or beneficiary shown. Include the will, trust, any amendments you can locate, and relevant account or property records. Mark missing documents, inconsistent names, unclear terms, and disagreements as questions; do not assume that a record resolves a conflict simply because it is the one you have.
- Write down the role named in each document and the person or institution identified for it.
- List each asset separately, with its known owner and beneficiary information.
- Set aside unclear provisions, disputed assets, and records you cannot verify for discussion with counsel.
Bring the unresolved questions to counsel
Before a conversation with counsel, note whether anyone has asked you to act, whether a court has appointed a personal representative, which trust documents and amendments you have, and which asset records remain uncertain. This makes it easier to separate a question about probate appointment from one about trust terms or ownership. Counsel can advise the person who may serve or is acting as executor or trustee; this does not mean the firm or its attorney will personally take on that fiduciary role.

Questions to discuss
If a will names me as executor, can I act for the estate right away?
A will may nominate an executor, but the probate court appoints the personal representative. A nomination alone is not that appointment. Clarify whether you have been appointed and what the appointment covers before acting for the estate.
Does being named successor trustee tell me which assets I can administer?
Not on its own. Trust administration depends on the trust terms and ownership of the assets. Compare the trust with available ownership records, and ask counsel about assets or provisions that remain unclear.
