Executor and Trustee Guidance in Stanford, Santa Clara County
If you have been nominated as an executor or successor trustee, first identify which document and assets may define your role. Codi M. Dada Law Office P.C. offers virtual services throughout California from its single physical office in Novato; Stanford is a service area, not a firm office.
Start by identifying the role and its source
A will can nominate an executor, but the probate court appoints a personal representative. A nomination therefore is not the same as a court appointment. Trust administration is different: it depends on the trust’s terms and on how assets are owned. A person named in one document should not assume that the document gives them authority over every asset or process. S1, S2
Before taking action, collect the will, any trust document and amendments, and any court papers or other communications you have received. Note the exact name of the role used in each document and whether a court has appointed a personal representative. These records help frame the discussion; they do not establish that you have authority to act.
- If you are nominated in a will, distinguish that nomination from a court appointment. S1
- If you are named in a trust, identify the trust terms and the assets you understand may be associated with it. S1, S2
Build an initial record set
For a remote consultation, gather what is already available rather than trying to resolve questions on your own. Useful starting records include the will and trust documents, amendments, court notices or filed papers, and a list of assets with any ownership or beneficiary records you have. Include recent correspondence about the estate or trust and a short timeline of important events. These materials can help counsel discuss whether the issue appears to concern a court process, trust administration, or both.
For each asset, record its general description, whose name appears on the ownership record, and where the record came from. Mark missing or uncertain information as such. Trust administration depends in part on asset ownership, so separating confirmed records from assumptions can make the initial conversation more focused. S1, S2
- Bring documents you have; do not delay a consultation simply because a record is missing.
- Keep a list of questions and events, and note which details you have not verified.
Keep probate and trust questions distinct
Probate and trust administration are not interchangeable labels. The will may nominate an executor, while appointment of a personal representative is a court function. Trust administration instead turns on the trust’s terms and asset ownership. A trust matter can still involve court proceedings when there is a dispute or an issue requiring interpretation; it should not be assumed that every trust matter stays outside court. S1, S2
A useful first question is: “Which assets and documents are relevant to the role I have been asked to take on?” Then ask whether there is an existing court matter, whether a court appointment has occurred, and what additional records would clarify the next step. These are questions for discussion, not a substitute for determining authority from the applicable documents and proceedings.
Prepare for a focused virtual consultation
Send or organize the documents you are comfortable discussing, and be ready to explain what you have been asked to do, by whom, and what decisions or concerns are pending. If several people are involved, write down their roles as you understand them without assuming that a family relationship establishes legal authority. Ask what information remains uncertain and what should be clarified before you act.

Stanford is in Santa Clara County. The Santa Clara County Superior Court’s probate calendar is an official court resource for general information, but it does not establish venue or provide instructions for a particular matter. Use it as a reference only when relevant, and raise case-specific questions with counsel. GEO, COUNTY
Questions to discuss
Does being named executor in a will mean I can act immediately?
Not by itself. A will may nominate an executor, but the probate court appoints a personal representative. Gather the will and any court papers, and clarify whether an appointment has occurred before treating the nomination as authority to act. S1, S2
What should I send before a virtual consultation?
If available, organize the will, trust and amendments, court papers or notices, asset ownership or beneficiary records, relevant correspondence, and a brief timeline. Note what is missing or uncertain. Trust administration depends on the trust terms and asset ownership, so those records can help identify the questions to discuss. S1, S2
