Start by organizing the records

Before deciding what steps may be needed, gather the trust and any amendments, the will, account statements, deeds, insurance or retirement beneficiary records, and available information about debts. Make a working list of each asset, its type, how it is owned, and its estimated value at the date of death. This information can help clarify whether an asset is trust property, has a named beneficiary, or may need a different transfer process.

For real estate, note the property address and look for the deed or other title records. Real property records are held by the recorder in the county where the property is located. A mailing address or the city where the family lives does not, by itself, determine which county’s records contain the deed.

  • List financial accounts and note how each is titled and whether it names a beneficiary.
  • Identify real estate and gather deeds, trust schedules, and available ownership records.
  • Keep contact details for beneficiaries, creditors, and institutions with relevant records.

Trust administration and assets outside the trust

A successor trustee generally begins by reviewing the trust document, confirming which assets are titled in the trust, and identifying property that may pass by beneficiary designation or another ownership arrangement. A trust plan depends on coordinating asset ownership with the plan; simply having a trust document does not establish that every asset is held in it.

Assets outside a trust may have a separate transfer route. The appropriate process depends on ownership, title, beneficiary designations, and other facts. Some situations may require court probate, while others may use a different procedure. A will can name a person to serve as executor, but nomination in a will is not the same as appointment by a court.

  • Compare the trust’s property list with current deeds and account records.
  • Separate assets titled in the trust from assets held individually or with another owner.
  • Flag missing title documents or conflicting beneficiary information for follow-up.

When court probate may be involved in Santa Clara County

Formal probate involves opening a court case, administering the estate, and closing the estate. If probate is needed, it is usually filed in the county where the person who died lived. When the person lived outside California but owned California property, a filing may be required in the county where that property is located. These are general location principles, not a rule that every San Jose resident must file in Santa Clara County.

In a probate case, the court appoints a personal representative. That person inventories estate assets, addresses debts, and reports to the court before final distribution. The Santa Clara County Superior Court’s probate calendar page provides hearing information set by the clerk and links to local rules, tentative rulings, and advance case-status reports. It also distinguishes electronic filing by attorneys from filing options for people without attorneys. Check the court’s current information for the relevant case.

Planning ahead in San Jose

Estate planning while you are alive is separate from trust administration and probate after death. A plan may include a will, living trust, financial power of attorney, and advance health care directive. A financial power of attorney concerns financial matters; an advance health care directive addresses health-care decisions. These documents serve different roles and should reflect the person’s circumstances.

Gather a current list of assets, existing planning documents, and questions about who should manage financial or health-care matters if you cannot. Keep important documents in a secure, known location and tell an appropriate person how to find them. A remote consultation does not automatically authorize remote signing or remote court appearances; the applicable requirements depend on the document or proceeding.

Common questions

Does every San Jose estate go through probate in Santa Clara County?

No. Whether probate is needed depends on the assets, ownership, trust title, beneficiary designations, and other circumstances. When a probate filing is needed, the decedent’s residence or the location of California property may matter more than a mailing label or family member’s address.

Can a remote consultation cover estate planning or administration?

Codi M. Dada Law Office P.C. offers virtual services across California. A remote consultation does not itself determine how a document must be signed or whether a court appearance can be remote; those questions depend on the specific document or proceeding.
