Executor and Trustee Guidance for Truckee Families
Being named in a will or trust does not answer every question about what you may do next. The key is to identify whether the asset is part of a probate estate or a trust, and what authority applies to that property. Codi M. Dada Law Office P.C. has one in-person office in Novato and provides virtual services throughout California.
Start with the asset and the authority
Before arranging a transfer or making a decision about property, identify how it is owned and which document governs it. A will may nominate an executor, but the probate court appoints the personal representative. A nomination is therefore not the same as court appointment.
Trust administration follows a different source of authority: the trust’s terms and ownership of the assets. An asset’s connection to a person who has died does not, by itself, tell you whether it is handled through a trust or a probate estate. These distinctions can change the next step, so begin by matching each asset to its ownership records and the relevant document.
- For an asset you believe belongs to a probate estate, check whether there has been a court appointment before treating the will’s nominee as authorized to act.
- For an asset you believe belongs to a trust, review the trust terms and ownership information together rather than relying on the title “successor trustee” alone.
Assemble a working record before taking action
A useful first step is to make a simple inventory of the property and the documents that may govern it. Gather the will, any available trust documents, and records showing how each asset is titled. For each item, note what the record says, which document you think applies, and what remains uncertain. This is a preparation tool, not a legal determination.
Also write down the decisions or transfers you are considering and the question that is holding them up. For example, if an account appears to be held in a trust but the available paperwork does not make that clear, identify the account and the conflicting or incomplete records. That gives counsel a concrete issue to assess without assuming the answer.
- Keep a separate list of assets whose ownership is unclear rather than grouping them automatically with the trust or probate estate.
- Preserve relevant correspondence and make a short timeline of steps already taken or proposed.
Executor authority and trustee authority are not interchangeable
A nominated executor’s role and a successor trustee’s role arise from different processes. The probate court appoints a personal representative; trust administration depends on the trust terms and ownership of assets. Do not assume that being named in one document gives authority over property governed by another.
Trust administration is not always free of court involvement. Disputes or questions requiring interpretation of the trust can bring a trust matter before a court. If the documents, ownership records, or interested parties point in different directions, pause to identify the specific uncertainty before treating a proposed action as routine.
Use Nevada County resources for probate information
The Nevada County Probate Division links to forms and packets and notes that not every estate requires formal probate. The type and ownership of property affect which transfer process may apply. Those county resources can help you locate probate materials, but they do not determine from a brief description whether a particular asset belongs to a trust or an estate.
When asking for guidance, bring the inventory and the records that show ownership, along with the will or trust documents you have. A focused question—such as whether a court appointment or trust authority is relevant to a particular asset—can help clarify which process to investigate next.
Discuss the next step with counsel
Codi M. Dada Law Office P.C. can advise the person acting as executor or trustee about the authority question presented by the available documents and asset records. Counsel to a fiduciary is distinct from serving personally as that fiduciary; any proposed role should be confirmed as part of an engagement.
For an initial discussion, organize the documents you have, list the property whose ownership is uncertain, and note any action you are considering. The goal is to identify what authority applies and what information is still needed before proceeding.
Questions to discuss
If a will names me as executor, can I act immediately?
A will may nominate an executor, but the probate court appoints the personal representative. Do not treat nomination alone as court appointment; clarify the status of the appointment before acting in that capacity.
Does being named successor trustee mean I control every asset?
Trust administration depends on the trust terms and ownership of the assets. Review those together; an asset’s ownership may affect whether it is handled through the trust or another process. Disputes or questions about interpreting the trust can require court involvement.
