Executor and Trustee Services for Lancaster Residents
If you have been nominated as an executor or named as a successor trustee, the first question is not simply what role appears in a document. Ask which source of authority applies to the particular asset you are considering. Codi M. Dada Law Office P.C. has one in-person office in Novato and provides virtual services throughout California.
Separate a will nomination from court appointment
A will may nominate an executor, but the probate court appoints a personal representative. Those are distinct steps. Being named in a will does not, by itself, establish that the probate court has appointed you to act as personal representative.
Before taking action for an estate, identify whether you are looking at a nomination or a court appointment. If the person who died lived in California, California Courts directs that probate be opened in the county where that person lived. If the person lived outside California but owned property here, its overview directs filing in the California county where the property is located. A mailing address alone does not assign a particular case.
Check ownership and trust terms asset by asset
A successor trustee’s authority is a different question from an executor’s nomination or a personal representative’s court appointment. Trust administration depends on the trust terms and on ownership of the assets. A person named as trustee should therefore identify the particular asset at issue and determine whether it is held by the trust before assuming the trust role governs it.
For example, if someone is named in both a will and a trust, the two designations do not answer the same question. The will may nominate an executor, while trust administration turns on the trust terms and asset ownership. The practical next step can change depending on which document and ownership record relate to the asset.
Organize records around the authority question
Before a conversation with counsel, you may find it useful to gather the will, any available trust document and amendments, and records that help identify how the assets are owned. Make a working list of the assets requiring attention and note which document or record appears relevant to each one. Mark unclear or conflicting information as a question rather than treating it as settled.
Then sort the questions by role: Is there a will nomination, and has the probate court appointed a personal representative? Does the trust document name you, and does the trust appear to own the asset? Is there an ownership issue or disagreement about what the trust means? This organization can help focus the discussion, but the list itself does not create authority to act.
Recognize when a trust question may need court involvement
Trust administration does not always remain a matter of following instructions without dispute. Trust matters can require court involvement when there are disputes or questions about interpreting the trust. If people disagree about a provision, or its meaning affects the asset or decision at issue, identify the specific language and disagreement before choosing a next step.
During formal probate administration, the personal representative generally needs to contact a probate referee to value nonmonetary or non-cash estate assets. This is a probate-administration consideration, not a rule for routine trust administration. Keeping the two processes distinct helps prevent a question about one role or asset from being treated as a requirement for another.
Bring the unresolved decision into focus
A useful starting point is to bring the relevant documents, your asset list, and the questions that remain unanswered. Ask which source of authority applies to each asset and what information is needed to resolve uncertainty. If you are a nominated executor, focus on the distinction between nomination and court appointment. If you are a successor trustee, focus on the trust terms, ownership, and any dispute or interpretation issue that may affect administration.

Questions to discuss
Can I act as personal representative just because a will names me executor?
A will may nominate an executor, but the probate court appoints the personal representative. Identify whether a court appointment applies before treating the nomination as authority to act for the estate.
Does being named successor trustee establish authority over every asset?
No. Trust administration depends on the trust terms and ownership of the particular assets. Check whether the asset is held by the trust and what the trust says before assuming the trustee role governs it.
