Estate Planning, Trust Administration & Probate in El Segundo

Plan ahead while you are alive

Estate planning is different from administering an estate after death. A plan may include a will, living trust, financial power of attorney and advance health care directive. These documents serve different purposes: a financial power of attorney addresses financial matters, while a health care directive addresses health care decisions.

A living trust plan also needs to be coordinated with ownership of your assets. When preparing for a planning discussion, gather existing wills or trust documents, deeds, account and beneficiary information, and a list of questions about who should manage financial or health care matters if you cannot. Keep important documents somewhere appropriate and make sure a trusted person knows where they are.

  • List major assets and note how each is owned, including whether an asset is titled in a trust.
  • Identify beneficiary designations and note where the related account or policy information can be found.
  • Bring existing estate planning documents and consider which people you may want to name for decision-making roles.

Trust administration after a death

Trust administration is the work of managing and distributing property held in a trust after the person who created it dies. The appropriate steps depend on the trust terms and how each asset is titled. A trust does not necessarily resolve every transfer: property outside the trust, beneficiary designations and other ownership arrangements may follow different procedures.

To prepare, gather the trust and amendments, death certificate information, asset statements, deeds and beneficiary records. Make an inventory that identifies each asset, its ownership, and its estimated value as of the date of death. This information helps clarify which transfer procedures may apply; it is not a substitute for reviewing the specific documents.

  • Separate assets titled in the trust from individually owned assets and assets with named beneficiaries.
  • For real property, note the property address and county and locate available deed records.
  • Keep records of communications, expenses and actions taken while administering the trust.

When formal probate may be involved

Not every estate requires formal probate. When it is required, formal probate generally involves opening a court case, administering the estate and closing the estate. A will may nominate an executor, but the nomination is not the same as appointment: the court appoints a personal representative. That representative inventories assets, addresses debts and reports to the court before final distribution.

The decedent’s residence and property ownership matter more than the mailing label on an address. Probate is usually filed in the county where the decedent lived. If the decedent lived outside California but owned property in California, a filing may be required where that property is located. Real property records are maintained by the recorder in the county where the property is located. The right location depends on the facts; El Segundo residence by itself does not mean every estate must be filed there or elsewhere in Los Angeles County.

  • Record the decedent’s actual residence and list property locations, ownership, trust title and beneficiary designations.
  • The Los Angeles Superior Court’s Stanley Mosk Courthouse probate directory distinguishes filing, records and wills services and separately explains probate-note procedures. Its listing is a resource, not a determination of the correct courthouse for every county resident.

Preparing for help from El Segundo

Codi M. Dada Law Office P.C. has one office at 802 Grant Ave, Novato, California, and provides virtual services statewide. A remote consultation can help discuss estate planning, trust administration or probate questions, but it does not automatically authorize remote signing or remote court appearances. Those arrangements depend on the circumstances and applicable requirements.

Before a consultation, organize documents by topic and write down the key dates, people involved and questions you need answered. For an estate matter, include the decedent’s residence, property locations and known ownership details. For planning, bring current documents and an asset list. Clear records make it easier to identify what needs review.

Common questions

Does living in El Segundo mean probate must be filed in Los Angeles County?

No. The decedent’s residence and the location and ownership of property are more relevant than a city or mailing label. Probate is usually filed in the county where the decedent lived, while California property owned by someone who lived out of state can affect where a filing is made. The appropriate location depends on the circumstances.

Does a virtual consultation mean documents can be signed or court appearances handled remotely?

No. A virtual consultation is a way to discuss your matter. It does not, by itself, authorize remote signing or a remote court appearance. The applicable requirements and arrangements depend on the specific situation.
