Estate Planning, Trust Administration & Probate in Humboldt County
When a loved one dies, a successor trustee may need to determine what the trust owns and what must be handled separately. Codi M. Dada Law Office P.C. offers virtual estate planning, trust administration and probate services across California from its Novato office.
Start trust administration with a clear asset picture
A successor trustee can begin by gathering the trust and amendments, death certificate, financial statements, property records, insurance and retirement account information, and any beneficiary designation records. Create an inventory noting each asset, how it is titled, its estimated value at the date of death, and where the supporting record can be found.
Trust administration generally concerns property held in the trust and the trustee’s responsibilities under the trust document. Assets titled to someone else, held jointly, or directed by a beneficiary designation may follow different transfer procedures. A trust does not automatically resolve every asset or eliminate the possibility of another proceeding. Check ownership and beneficiary information rather than assuming that an asset belongs to the trust.
- List accounts and property separately, including the name or names on each title.
- Record outstanding debts and relevant contact information for financial institutions.
- For real property, note its location and locate the deed or other ownership record. Property records are held by the recorder in the county where the property is located.
Plan for your own care and property while living
Estate planning is different from administering a trust after death or handling a court probate. A plan may include a will, living trust, financial power of attorney and advance health care directive. These documents serve distinct purposes: a financial power of attorney addresses financial decision-making, while an advance health care directive addresses health care decisions.
A living trust plan depends on coordinating asset ownership with the trust. A trust document alone may not control property that was never transferred to it, and beneficiary designations may direct assets independently. Keep important documents together or make sure an appropriate person knows where they are kept. A consultation can help you identify what records and decisions to review; a remote meeting does not itself authorize remote signing of documents.
When court probate may be involved
Probate is a court-supervised process for handling an estate when required. It is separate from trust administration, and not every estate necessarily requires formal probate. In a formal probate, the process includes opening a case, administering the estate and closing it. The court appoints a personal representative to inventory assets, address debts and report before final distribution. A will may nominate an executor, but nomination is not the same as court appointment.
For a person who lived in California, probate is usually filed in the county where the person lived. If the person lived outside California but owned property in the state, a filing may be required where that California property is located. The person’s residence and the location of property can therefore matter more than a mailing label. A Humboldt County connection alone does not mean every resident or family must file there; the relevant facts depend on the decedent’s residence and property ownership.
Humboldt County records and practical logistics
The Humboldt County Superior Court identifies its Civil Division as handling non-guardianship probate, trust and conservatorship cases. Its listed physical Civil Division address differs from its mailing address in Eureka, so confirm the current court information before sending or delivering documents. The court also states that its Self-Help Center does not assist with estate matters.
Codi M. Dada Law Office P.C. has one in-person office at 802 Grant Ave, Novato, CA 94945, and offers virtual services statewide, including for Humboldt County matters. Virtual consultations can help with document organization and planning, but they do not automatically make court appearances available remotely. Court participation requirements should be confirmed for the particular proceeding.

Common questions
Does having a living trust mean my family will not need probate?
Not necessarily. Trust property is generally handled through trust administration, but assets outside the trust may have different transfer procedures. Ownership, title, beneficiary designations and the circumstances of the estate determine what steps may be needed.
Does every Humboldt County resident file probate in Humboldt County?
No. Probate venue usually relates to where the decedent lived, while California property owned by someone who lived outside the state can affect where a filing is made. The relevant residence and property facts matter more than a mailing address or a general county connection.
