Executor and Trustee Guidance for South San Francisco
Named as an executor in a will or asked to act as a successor trustee? The two roles draw authority from different sources, so the first step is to identify which one applies and what remains to be established. Codi M. Dada Law Office P.C. has one in-person office in Novato and provides virtual services throughout California.
A will nomination is not the same as appointment
A will may nominate an executor, but the probate court appoints the personal representative. Being named in the will therefore does not, by itself, mean you have been appointed to act in that role. Before treating yourself as authorized to handle estate matters, distinguish the nomination from the court’s appointment.
This is a different source of authority from a successor trustee’s. Trust administration depends on the trust terms and on which assets are owned by the trust. A family request, a title such as “successor trustee,” or a will nomination does not answer every question about what property is involved or what authority applies.
Choose guidance for the role you actually have
Start by clarifying whether you have been nominated in a will, have been asked to take over as trustee, or are trying to understand both roles. For a nominated executor, the central question is what remains before the probate court appoints a personal representative. For a successor trustee, the starting points are the trust terms and records showing which assets the trust owns.
Counsel to a person acting as executor or trustee is distinct from someone taking on the fiduciary role. When discussing legal guidance, ask what role the work is intended to address, which documents and issues are in scope, and what decisions remain yours. Do not assume that counsel will personally serve as executor or trustee; clarify that separately if it matters to your decision.
The right starting point may also change if there is a disagreement about the trust or a question that requires interpreting its terms. Trust administration can involve court proceedings in those circumstances, but the existence of a trust does not by itself establish whether court involvement is needed.
Gather records without treating assumptions as authority
You may find it useful to gather the will or trust, any available documents identifying a proposed successor, and records showing how known assets are titled or owned. A working list can note the asset, the named owner, where the information came from, and whether the detail has been verified. Keep uncertain items marked as uncertain rather than converting estimates or recollections into confirmed facts.
You can also make a brief timeline of what has happened, list questions or decisions that seem pending, and collect relevant correspondence. These are optional preparation steps, not a substitute for determining the source and extent of authority. The distinction matters: trust administration depends on the trust terms and asset ownership, while a nominated executor still needs the probate court’s appointment as personal representative.
Before acting on a transaction or treating property as available for distribution, identify what document or appointment you believe authorizes that step and what remains unclear. Bring those questions forward for discussion rather than assuming the same process applies to estate and trust property.
Court questions depend on the matter, not just the mailing address
California Courts directs that formal probate be opened in the county where the decedent lived. If the decedent lived outside California but owned property in California, its overview directs filing in the California county where that property is located. A South San Francisco mailing address alone does not establish where a particular matter should be filed.
The San Mateo County Probate Division handles decedent estates and trusts. If that resource applies to your matter, consult its current division and case instructions rather than assuming a particular assignment from a city address. During formal probate administration, the personal representative generally needs to contact a probate referee to value nonmonetary or non-cash estate assets.
A useful next step is to identify the role you have been asked to take, assemble the governing document and available ownership records, and write down what authority or next action is uncertain. That makes it easier to focus the conversation on appointment, trust terms, asset ownership, or a possible dispute.
Questions to discuss
If a will names me as executor, can I immediately act for the estate?
A will may nominate you, but the probate court appoints the personal representative. The nomination and the appointment are distinct; clarify whether you have been appointed before treating yourself as authorized to act in that capacity.
Does a successor trustee always handle trust matters without court involvement?
No. Trust administration depends on the trust terms and which assets are owned by the trust. Disputes or questions requiring interpretation can involve the court, so the applicable documents and issue matter.
