Executor and Trustee Services for Placentia Residents
If you have been named executor or successor trustee, first determine which document and which assets your role concerns. A will’s nomination is not the same as a probate court appointment, while trustee authority depends on the trust terms and asset ownership. Codi M. Dada Law Office P.C. has one in-person office in Novato and provides virtual services throughout California.
Identify the authority behind your role
A will may nominate an executor, but the probate court appoints a personal representative. If you are named in a will, that nomination alone does not establish that you have been appointed to act as the personal representative. Clarify whether you are nominated, appointed, or serving in another capacity before relying on the will as authority for a particular step.
A successor trustee’s role is different. Trust administration depends on the trust’s terms and on how the assets are owned. The name of a person in a document is a starting point, not a complete answer about which assets that person may administer or what further authority may be needed.
Connect each asset to the right process
A person may be nominated as executor in a will and named as successor trustee in a trust. Those are separate roles, and the nomination in the will does not itself appoint that person as personal representative. For trust administration, the trust terms and ownership of the assets are central to identifying what falls within the trustee’s role.
As a practical preparation step, make a list of assets you know about and note what available ownership record or document appears relevant to each one. Keep uncertain items marked as uncertain. This is an organizing tool, not a legal determination that a particular asset belongs to a probate estate or trust.
Gather documents and questions before acting
You may find it useful to gather the will, the trust and any available amendments, records showing how assets are owned, relevant correspondence, and any court papers or orders. Arrange them so it is easy to see which document relates to each question. If records conflict or leave an issue unclear, note the gap rather than choosing one interpretation on your own.
Prepare questions about your status, the assets involved, and the decision you are considering. Ask what authority comes from the documents, whether a court appointment or order applies, and what remains unresolved. This preparation can make a conversation with counsel more focused; it does not itself grant authority or settle a dispute.
Recognize when further authority or court involvement may matter
Trust administration does not always resolve every issue without court involvement. A dispute or question requiring interpretation of the trust can require court involvement. If there is disagreement about what the trust means or which assets it covers, distinguish the disputed question from what the documents and ownership records clearly show.
For a probate matter, the county where the decedent lived generally determines where probate is opened. If the decedent lived outside California but owned property in California, California Courts directs filing in the California county where that property is located. Placentia is not by itself a basis to assume a particular probate case belongs in Orange County. During formal probate administration, the personal representative generally needs to contact a probate referee to value non-cash estate assets.
Use court information as a starting point
When a matter is in Orange County, Probate Case Access is an online court resource. The court cautions that online information is not the official court record and may contain errors or omissions. Confirm required records and orders through the court rather than treating an online entry as definitive.
A useful next step is to bring your organized documents and asset list to a discussion with counsel. Focus on what role you hold, which assets are in question, and whether an appointment, order, or interpretation issue needs attention. The purpose is to separate what the available records establish from what still needs clarification.
Questions to discuss
Does being named executor in a will mean I can act as personal representative?
No. A will may nominate an executor, but the probate court appoints the personal representative. Confirm whether an appointment applies before assuming that the nomination alone gives you that authority.
Does a successor trustee automatically handle every asset?
Not necessarily. Trust administration depends on the trust terms and asset ownership. Review those together to understand which assets relate to the trust; disputes or interpretation issues can require court involvement.
