Plan for incapacity while you are living

Estate planning can prepare for decisions during your lifetime as well as for the transfer of property after death. A plan may include a will, living trust, financial power of attorney and advance health care directive. These documents have different roles: a financial power of attorney concerns financial matters, while a health care directive addresses health care decisions.

Before preparing or updating documents, make a working list of your assets and how each is owned. Include real estate, financial accounts, business or personal property, and any beneficiary designations you know about. Note whether property is individually owned, jointly held or titled in a trust, and gather existing estate documents. Ownership and beneficiary arrangements can affect how an asset transfers, so a document’s instructions should be coordinated with the way assets are held.

Choose people you trust for the roles your plan calls for, and make sure an appropriate person knows where important documents are kept. A will can nominate an executor, but nomination is not the same as appointment: if court probate is needed, the court appoints a personal representative.

After a death: identify the assets and transfer path

A death does not automatically mean that every asset must pass through court probate. The transfer process depends on factors such as ownership, trust title, beneficiary designations and the type of property. A trust may guide administration of assets titled in it, but other assets may require a different process or court involvement.

Start by gathering the death-related and estate documents available to you, along with account statements, deeds, insurance or retirement beneficiary information, and records of debts. Create an inventory that describes each asset, how it is owned and its estimated value as of the date of death. This information helps clarify which transfer procedures may apply; it is not a substitute for checking title and account records.

San Joaquin County location depends on residence and property

Manteca is in San Joaquin County, but a Manteca mailing address alone does not determine where an estate matter belongs. For formal probate, the usual filing county is where the decedent lived. If the decedent lived outside California but owned property in the state, a filing may be required in the county where that California property is located. The relevant residence and property ownership—not simply the address on mail—help determine the appropriate location.

Real property records are held by the recorder in the county where the property is located. For a Manteca property, that means checking the San Joaquin County records for ownership and title information. If a court probate case is underway, the San Joaquin County Superior Court publishes probate notes and tentative rulings searchable by case number. A probate note can flag an issue needing correction or explanation; it is not itself a final order.

How probate administration differs from trust administration

Formal probate generally involves opening a court case, administering the estate and closing the case. The court appoints a personal representative, who identifies and inventories assets, addresses debts and reports to the court before final distribution. The person named as executor in a will may be nominated for the role, but the court appointment is a separate step.

Trust administration is a separate process focused on administering property held in a trust under its terms. It does not make every asset part of the trust or eliminate the need to assess other transfer procedures. Codi M. Dada Law Office P.C. offers virtual services statewide and has one in-person office at 802 Grant Ave, Novato. A remote consultation does not automatically authorize remote signing of documents or remote court appearances; those arrangements depend on the requirements that apply to the particular matter.

Common questions

Does every Manteca estate have to go through probate?

No. The transfer route depends on the assets, how they were owned, trust title and beneficiary designations. Reviewing an asset inventory and ownership records can help identify whether court probate may be needed.

Does a Manteca address determine where probate is filed?

Not by itself. The decedent’s residence is generally the key location for a formal probate filing. For a decedent who lived outside California but owned California property, the county where that property is located may matter. A mailing label alone does not establish the appropriate filing location.
