Start with the trust records and asset ownership

A successor trustee can begin by locating the trust and any amendments, a will, financial records, property documents, insurance information, and beneficiary designations. Make an inventory that identifies each asset, how it is titled, its estimated value at the date of death, and any named beneficiary. Keep copies of relevant statements and documents together, and note which information still needs to be confirmed.

The trust document can help identify the successor trustee and explain the trustee’s responsibilities. But the title and beneficiary designation for each asset matter too. Property titled in the trust may be handled through trust administration, while assets held individually or with a beneficiary designation may follow different transfer procedures. A will may direct some property, but it does not itself establish that every asset will be transferred through the trust.

Moreno Valley, Riverside County, and property records

Moreno Valley is in Riverside County, but a mailing address or city label alone does not determine where an estate matter belongs. For a person who lived in California, formal probate is usually filed in the county where the person lived. If the decedent lived outside California but owned property in the state, a filing may be required in the county where that property is located.

For real estate, the county recorder where the property is located holds the property records. Review the deed and related records to confirm ownership and whether the property was titled in a trust. If a court proceeding is needed, Riverside County Superior Court provides separate information about filing locations, probate notes, case access, and remote appearances. The actual case assignment should be verified rather than choosing a courthouse based only on the property’s or decedent’s city.

Trust administration and court probate are different processes

Trust administration generally concerns carrying out the trust’s terms for assets held in the trust. The successor trustee should review the trust, confirm the assets and beneficiaries, and organize records of administration. Whether an asset belongs in this process depends on its ownership and applicable transfer arrangements.

Court probate is a separate process for assets that require court-supervised administration. In formal probate, a case is opened, the estate is administered, and the matter is closed. A will may nominate an executor, but the court appoints the personal representative. That representative inventories assets, addresses debts, and reports to the court before final distribution. Not every estate requires probate, and the need for it cannot be determined from a will alone.

Plan ahead while you are able

Estate planning can include a will, living trust, financial power of attorney, and advance health care directive. These documents serve different purposes: a financial power of attorney addresses financial matters during life, while a health care directive addresses health care decisions. A trust plan also requires coordination between the trust and asset ownership; signing a trust document alone does not show that every asset is titled in the trust.

Keep important documents in a known, secure place and make sure an appropriate person knows how to locate them. Consultations are available virtually across California, but a remote consultation does not automatically make document signing or a court appearance remote.

Common questions

Does every Moreno Valley estate go through Riverside County probate?

No. Whether probate is needed depends on the assets, how they were owned, and any applicable trust or beneficiary arrangements. When probate is required, the decedent’s residence and the location of California property can matter; a Moreno Valley mailing address alone does not decide the filing location or courthouse assignment.

What should a successor trustee gather first?

Locate the trust and amendments, will, deeds, account records, insurance information, and beneficiary designations. Prepare an asset list showing ownership, estimated date-of-death value, and any named beneficiary. These details help distinguish trust assets from property that may require another transfer process.
