Start with the records a successor trustee will need

When someone dies with a trust, the successor trustee often begins by gathering the trust and any amendments, a death certificate, account statements, deeds, insurance or retirement beneficiary records, and information about outstanding debts. A clear inventory can help show what the trust owns and what may pass through another process.

For each asset, note its type, how it is titled, any named beneficiary, and its estimated value as of the date of death. Trust documents alone may not establish that an asset is held in the trust. Ownership, trust title and beneficiary designations can affect how an asset transfers. Real-property records are maintained by the recorder in the county where the property is located, so Indian Wells real estate records would be sought in Riverside County.

  • Gather the signed trust, amendments, deeds and available account records.
  • List each asset’s owner or title, beneficiary designation and estimated date-of-death value.
  • Keep a separate record of known debts, recurring expenses and correspondence.

Trust administration is different from court probate

Trust administration is the work of carrying out the trust after the person who created it has died. The successor trustee reviews the governing documents, identifies trust property, addresses administration tasks and distributes property as the trust provides. Assets outside the trust may need a different transfer procedure, depending on their ownership and beneficiary arrangements. A trust does not automatically resolve every asset or rule out every court proceeding.

Court probate is a separate process for administering an estate through a court. Formal probate generally involves opening a case, administering the estate and closing it. A court appoints a personal representative, who inventories assets, addresses debts and reports to the court before final distribution. A will may nominate an executor, but the nomination is not itself a court appointment.

Plan while you are living

Estate planning can include a will, living trust, financial power of attorney and advance health care directive. These documents serve different roles: a financial power of attorney addresses financial decision-making, while an advance health care directive concerns health-care decisions. A plan should also coordinate asset ownership with the trust so that records and intended transfers work together.

Before a planning conversation, consider your priorities, the people you may want to name for decision-making roles, and the assets you own individually, jointly or through a business. Bring existing estate documents and a basic list of accounts and real property. Tell an appropriate person where important documents are kept. A virtual consultation can support planning, but it does not automatically authorize remote signing; signing requirements depend on the document and circumstances.

Indian Wells and Riverside County court logistics

For probate, the decedent’s residence and the location and ownership of property matter more than a mailing label or the city where a family member lives. Probate is usually filed in the county where the decedent lived; when a person who lived outside California owned property in California, filing may be required where that property is located. Not every Indian Wells resident or family will need to file a probate case.

The Riverside County Superior Court Probate Division lists Riverside, Palm Springs and Southwest Justice Center locations, along with separate information about where to file, probate notes, case access and remote appearances. Do not select a courthouse solely because a property or mailing address says Indian Wells; verify the actual case assignment. Remote consultations do not guarantee that a court appearance can be remote.

Common questions

Does an Indian Wells address determine where probate must be filed?

Not by itself. The decedent’s residence and property ownership are relevant, and an address label alone does not establish the filing location. Check the Riverside County Probate Division’s filing and case-assignment information for the specific matter.

What should a successor trustee collect first?

Start with the trust and amendments, deeds, account statements, beneficiary records, debt information and a list of assets showing how each is owned. Include estimated values as of the date of death; these details help distinguish trust property from assets that may require another transfer process.
