Estate Planning, Trust Administration & Probate in Loomis, California

Loomis is in Placer County, but a mailing address alone does not determine where an estate matter belongs. Codi M. Dada Law Office P.C. provides virtual services across California from its Novato office.

Start with where the person lived and what they owned

For probate planning after a death, the decedent’s residence and the location and ownership of property are more useful than the city printed on a mailing label. Formal probate is usually filed in the county where the decedent lived. If someone lived outside California but owned property here, a filing may be needed in the county where that California property is located. Not every estate requires court probate.

Before deciding how assets may be transferred, gather a list showing each asset, its type, how it was owned, and its estimated value on the date of death. Include deeds, account statements, trust documents, and beneficiary information where available. Ownership, trust title, and beneficiary designations can lead to different transfer procedures.

  • For real estate, note the property address and county; property records are kept by the recorder in the county where the real estate is located.
  • For accounts and insurance, identify the named owner and any beneficiary designation.
  • Record whether a trust owns an asset, rather than assuming a reference to the trust in a document changed title.

Planning while you are alive

Estate planning creates instructions and decision-making arrangements for use during life and after death. Depending on a person’s needs, a plan may include a will, living trust, financial power of attorney, and advance health care directive. These documents have different roles: a financial power of attorney addresses financial decisions, while a health care directive addresses health care choices.

A will can nominate an executor, but nomination is not the same as appointment. In a court probate, the court appoints a personal representative. A living trust plan also needs coordination between the trust and ownership of assets; signing trust documents alone does not establish that every asset is titled in the trust. Keep important documents accessible and make sure an appropriate person knows where they are.

  • Prepare a current asset and debt list, including ownership details and beneficiary designations.
  • Collect existing wills, trust documents, deeds, and powers of attorney so they can be considered together.

Trust administration or court probate

When a person dies, trust administration concerns handling assets held in a trust under its terms. Court probate is a separate process for estate assets that require court-supervised administration. A trust may simplify transfer of assets titled to it, but it does not guarantee that no court proceeding will be needed; other assets or circumstances may call for a different process.

Formal probate generally involves opening a case, administering the estate, and closing the case. The court-appointed personal representative inventories assets, addresses debts, and reports before final distribution. If a will names an executor, that person’s nomination does not itself confer authority to act as the court-appointed representative.

Common questions

Does a Loomis address mean probate must be filed in Placer County?

Not by itself. The decedent’s residence is generally the key starting point, and California property owned by someone who lived elsewhere may point to the county where that property is located. A mailing label alone does not decide the proper location.

Can a virtual consultation mean documents can be signed or court appearances handled remotely?

No. A remote consultation does not automatically authorize remote signing or a remote court appearance. The appropriate arrangements depend on the document and proceeding; the Placer County Superior Court’s probate information identifies its Civil Division for probate estate and trust matters and provides local court resources.
