Review a Sonoma estate plan after a life or property change

Marriage, separation, a new child, a move, or buying or selling property can affect whether an existing plan still reflects your wishes. Review the documents together and note what has changed: who should manage finances or health-care decisions, who should receive property, and whether current assets are titled consistently with the plan.

An estate plan may include a will, a living trust, a financial power of attorney and an advance health care directive. These documents do different jobs. A financial power of attorney addresses financial matters, while a health-care directive addresses health-care decisions. A will names an executor as a proposed representative, but nomination is not the same as appointment by a court.

If your plan includes a trust, review how property is owned and whether relevant assets are titled in a way that coordinates with the trust. Keep a current list of important documents and tell an appropriate person where they can be found. A consultation can help identify documents to update and questions that need attention; meeting remotely does not by itself authorize remote signing.

Sonoma location: residence and property records matter

Sonoma is in Sonoma County, but a mailing label or city name alone does not determine where an estate matter belongs. For formal probate, the usual starting point is the county where the person who died lived. If the person lived outside California but owned property in California, filing may be required where that property is located. The relevant facts are the decedent’s residence and the location and ownership of assets, not simply the address used for mail.

To prepare for a discussion about an estate, gather the decedent’s current and prior addresses, any will or trust, account and property information, and available beneficiary-designation records. For each asset, record its type, how it is owned, and its estimated value as of the date of death. Real-property records are kept by the recorder in the county where the property is located. Ownership, trust title and beneficiary designations can affect which transfer procedures apply.

Trust administration and court probate are different processes

Trust administration concerns carrying out a trust after a death or other event under the trust’s terms. The person administering it will need to review the trust, identify assets held in the trust, and understand any property or accounts that may be owned or designated differently. A trust does not automatically resolve every transfer issue; the assets’ ownership and the circumstances matter.

Court probate is a separate process that may be needed to transfer property. Formal probate generally involves opening a court case, administering the estate and closing the case. If probate is required, a court appoints a personal representative. That representative inventories assets, addresses debts and reports to the court before final distribution. Not every estate requires probate, and having a will does not, by itself, eliminate the possibility of probate.

Preparing for Sonoma probate logistics

The Sonoma County Superior Court publishes a probate calendar with hearing categories and department information. Check the court’s current calendar and case-specific instructions when preparing for a hearing; a general calendar is not a personal hearing notice. Remote consultations are available, but they do not automatically authorize a remote court appearance. Follow the instructions that apply to the specific case.

Common questions

Does every Sonoma resident have to file probate in Sonoma County?

No. Whether probate is needed depends on the estate and how assets are owned or designated. When formal probate is appropriate, the usual filing location is the county where the decedent lived; California property owned by someone who lived outside the state can raise a filing location tied to where that property is located. A city or mailing address alone does not settle the issue.

Does a will keep an estate out of probate?

Not necessarily. A will can state wishes and nominate an executor, but a nomination is not a court appointment. If formal probate is required, the court appoints a personal representative to administer the estate. Whether probate is needed depends on the assets, ownership and applicable transfer procedures.
