Plan for incapacity while you are able

Planning during your lifetime is different from administering a trust or handling probate after a death. A plan may include a will, living trust, financial power of attorney and advance health care directive. A financial power of attorney addresses financial matters, while a health care directive addresses health care decisions; neither document takes the place of the other.

For a useful planning conversation, gather information about what you own, how each asset is titled, and whether it has a beneficiary designation. Note which property is held in a trust and where important documents are kept. A trust plan depends on coordinating ownership with the plan: having a trust document alone does not establish that every asset is titled in the trust.

Sierra County property and transfer questions

The right transfer process depends on the property, its ownership, trust title and beneficiary designations—not simply the address on a mailing label. For each asset, record its type, how it is owned and its estimated value as of the owner’s date of death. Include real property and identify the county where each parcel is located.

Real property records are kept by the recorder in the county where the property is located. When a person dies, the county where that person lived is usually relevant to where a formal probate case is filed. If the person lived outside California but owned property in California, the location of that California property can matter. These are general considerations, not a rule that every Sierra County resident or property owner must file a case there.

Trust administration and court probate are different

After a death, trust administration generally concerns property held in a trust and the responsibilities involved in carrying out its terms. The trustee’s work is distinct from a court probate case. Ownership and beneficiary designations may affect which transfer procedures apply, and some circumstances can involve court proceedings even when a trust exists.

Formal probate is a court process that includes opening a case, administering the estate and closing it. A will may nominate an executor, but the nomination is not the same as appointment: the court appoints a personal representative. That representative inventories assets, addresses debts and reports to the court before final distribution. Not every estate requires formal probate, and having a will does not by itself avoid it.

Sierra County court information and remote planning

The Sierra County Superior Court’s Probate & Conservatorship division provides information concerning decedent estates and trusts, including procedures for remote appearances. Whether a remote appearance is permitted depends on the type of hearing and applicable procedures. A virtual consultation with the firm does not automatically authorize remote signing of documents or remote attendance at a court proceeding.

Codi M. Dada Law Office P.C. has one office at 802 Grant Ave, Novato, California, and offers virtual services statewide. For an initial discussion, prepare a list of assets and their ownership, any known trust or beneficiary designations, and the documents you have located. This helps identify which questions concern lifetime planning, trust administration or a possible probate matter.

Common questions

Does owning property in Sierra County mean probate must be filed there?

Not necessarily. The decedent’s residence and the location and ownership of property can affect where a case may be filed and which transfer process applies. An asset inventory, including the county where real property is located, can help clarify the issue.

Can I meet virtually about a probate or trust matter?

The firm offers virtual services across California. A virtual meeting is separate from court procedures: permission for a remote hearing depends on the hearing type, and a virtual consultation does not itself permit remote document signing or a remote court appearance.
