Plan for incapacity while you are living

Estate planning can prepare for both financial and health-care decisions if you become unable to manage them yourself. A plan may include a will, living trust, financial power of attorney, and advance health care directive. These documents serve different purposes: a financial power of attorney addresses financial matters, while a health-care directive addresses health-care decisions.

Before preparing documents, make a clear inventory of your assets and obligations. For each asset, note what it is, how it is owned, and whether a beneficiary is named. Include real property, accounts, and other significant holdings. If you own property in Mono County, note its location and how title is held. A trust plan needs to coordinate with asset ownership; signing a trust document alone does not explain how every asset will transfer.

Keep important documents organized and let an appropriate person know where they can be found. A remote consultation can help with planning, but it does not automatically authorize remote signing or remote court appearances. Any signing or appearance requirements should be considered separately.

Trust administration after a death

When a person dies with a trust, the successor trustee may need to identify trust property, review the trust terms, address expenses and obligations, and arrange distribution. The work depends on what the trust says and whether assets were actually titled in the trust. Assets held outside it, jointly owned property, and assets with beneficiary designations may follow different transfer procedures.

Start by gathering the trust and any amendments, deeds, account statements, beneficiary information, and records of debts and expenses. For real property in Mono County, the county recorder is the office that holds property records for that county. Reviewing those records alongside the trust and other ownership documents can help clarify what is part of the trust and what may need a different process. Trust administration is distinct from court probate, though a particular estate may involve more than one procedure.

Court probate and the importance of residence and ownership

Not every estate requires court probate. When formal probate is needed, it generally involves opening a court case, administering the estate, and closing the case. Usually, a probate case is filed in the county where the person who died lived. If that person lived outside California but owned property in California, a filing may be needed in the county where that property is located.

A mailing address or the location where a document was signed does not, by itself, establish where a probate case belongs. The person’s actual residence and the location and ownership of property matter. A court appoints a personal representative; a will’s nomination of an executor is not itself a court appointment. The appointed representative inventories assets, addresses debts, and reports to the court before final distribution.

To prepare for a discussion, collect the will or trust, any amendments, a list of assets, ownership and beneficiary information, estimated date-of-death values, and known debts. Mono County Superior Court publishes a Probate & Conservatorship resource. Its conservatorship instructions are not estate-probate filing instructions, so check that resource for relevant probate information rather than treating the two processes as interchangeable.

Common questions

Does owning property in Mono County mean probate must be filed there?

Not necessarily. The usual starting point is the county where the person who died lived. If the person lived outside California and owned California property, the county where that property is located may matter. Ownership, trust title, and beneficiary designations can also affect the transfer process.

What should I gather before discussing a Mono County estate?

Collect the will or trust and amendments, a list of assets, deeds and account records showing ownership, beneficiary information, estimated date-of-death values, and known debts. For Mono County real property, county recorder records may help clarify how title is held.
